I don't think he actively defends him, I think he said one thing one time and pitchfork hyped it up. It's also not fair use that is the loophole, fair use would only apply to educational and some other areas like that and if my copyright law memory serves me, that goes back to a case from the 1800's. The loophole he uses is something like you can create a collage for artistic purposes. It's some really weird law.
But try to pick up a new copy of Notorious B.I.G.'s album "Ready to Die" that got pulled because he sampled the Ohio Players without permission and the label got fined $4.2 million. That is just one example.
He can play the stuff live, even be able to give it away for free, but when you make a profit from others peoples work that's where I think he will run into problems. If he does start to make some serious cash from the release, it will be hard for his labels lawyers to go against the publishing companies and major record label lawyers.

This is his 4th LP and there haven't been any issues so far. He's been playing festivals as a very popular artist the last 2 years along w/ some of the artists he's sampling.
Not sure what you're getting out, sounds like you have a personal grudge against him haha.

Of course I have a grudge I'm Lil Wayne and he stole my shit, no grudge actually. I just don't think he has hit the level where money from album sales has become in an issue, with this release after all of the hype this will undoubtedly be his best selling album yet, most likely bigger than all other album sales combined. This is when I think it will get interesting.
